The question of civil disobedience has preoccupied philosophical discourse at least since Thoreau's articulation of disobedience as a form of non-compliance and Rawls' classic definition outlined in the wake of the civil rights and student protest movements of the 1960s. It has become increasingly clear, however, that these classic definitions are being challenged and rethought from a variety of traditions in the wake of contemporary protests. These articles engage with the most recent debates surrounding civil disobedience and conscientious (...) objection, opening up original new paths for thinking about forms of protest. They also reveal disagreements about how to understand civil disobedience and about the place of conscience in political protest, inviting further discussion on these questions and issues. (shrink)

The French Revolution had a complex relationship with historical thought. In a significant sense, the politics of 1789 was built upon a rejection of the authority of the past. As old institutions and practices were swept away, many champions of the Revolution attacked conventional historical modes for legitimating authority, seeking to replace them with a politics anchored in notions of reason, natural law and natural rights. Yet history was not so easily purged from politics. In practice, symbols and images borrowed (...) from the past saturated Revolutionary culture. The factional disputes of the 1790s, too, invoked history in a range of ways. The politics of nature itself often relied on a range of historical propositions and, as the Revolution developed, a new battle between “ancients” and ‘moderns’ gradually emerged amongst those seeking to direct the future of France. This article explores these issues by focusing on a series of lectures delivered at the École Normale in the Year III (1795), in the wake of Thermidor and the fall of Robespierre. The lectures, commissioned by the Ministry of Education, were designed to lay out a program for historical pedagogy in the French Republic. Their author, Constantin-Francois Volney (1757–1820), was one of a group of figures who sought, during these years, to stabilise French politics by tying it to the development of a new form of social science—a science that would eventually be labelled “idéologie.” With this in mind, Volney sought to promote historical study as an antidote to the political appropriation of the past, with particular reference to its recent uses in France. In doing so, he also sought to appropriate the past for political purposes. These lectures illustrate a series of tensions in the wider Revolutionary relationship with history, particularly during the Thermidorian moment. They also, however, reflect ongoing ambiguities in the social role of the discipline and the self-understanding of its practitioners. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Dmitry Khanin THE POSTMODERN POSTURE Postmodernists—the sectarians ofour day—proclaim that the old kingdom of historical narrative and historical subject has perished, and is now being replaced by a new one of ahistorical discourses and ahistorical characters. According to these prophets, "history" is anyway just changes in ways of talking about history. Anyone who does not agree with the ahistoricity of the postmodern world oudook may be accused—and tried on (...) the spot—of defending the cause of the totalitarian Reason against the most liberating movement of today. This postmodernist abuse of history is paradoxical, since the very notion of history coming to its end and giving way to the ahistorical kingdom of freedom and merry debauchery is itself a very old idea, even a mythological one. The description ofhistory as marching toward its own demise relies on a whole tradition which portrays history as a drama. Aristode's conception of tragedy as a sequence of actions culminating in a dénouement has no doubt shaped this view of historical process. Christian and other religious millenarians have announced the end of history already many times. Yet another notorious instance of such eschatological daydreaming is the futurology of Karl Marx, who envisaged the kingdom of communism as occupying this same ahistorical space. A rather obsolete idea, perhaps, but it seems still to attract postmodernists, though they give it a characteristic twist, since they sincerely believe theory, discourse, écriture (i.e., theoretico-symbolical activity) are much more important than any actual historical contentprocesses and events. One of the most notable spokesmen for this approach is Arthur Danto, who insists that world history evolved in a good Hegelian manner until the theorists came to understand that history depends on their Philosophy and Literature, © 1990, 14: 239-247 240Philosophy and Literature texts much more than theorists themselves depend on historical processes and events.1 Many theoreticians working in an otherwise Marxist tradition similarly are glad to assert with FredricJameson that we must say farewell to Marx's positivistic illusion that history is driven by laws disguised as economic forces.2 In the epoch of "late capitalism," says Jameson, consumption gains the upper hand over production and becomes the mainspring of history. Of course, in light of recent doings in Europe I am tempted to ask if we owe it to postmodernists—and their ahistorical, inconsistent, and generally confounding claims about history lying in ruins—that the Berlin Wall actually is in ruins and Vaclav Havel is president of Czechoslovakia. Even more daring theorists may now declare an era of "very late capitalism." Here it will not be merely the mass media that act transformatively on society (as McLuhan claimed), but rather consumer goods themselves, like state-of-the-art washing machines or French perfumes, which create a new aura of intellectual discourse. TL· Postmodern Scene: Excremental Culture and Hyper-AesÜietics, a book by two Canadian authors, Arthur Kroker and David Cook, promotes such a sea change in the theoretical landscape and along the way presents a joyous recapitulation ofthe latest fads in postmodern thinking. The new apostolic generation ofpostmodern critics seems to enjoy the beautiful new things that can be bought for bucks, worrying at the same time that bucks may be losing some of their purchasing power. Like Hari-Krishnas dancing in the street they luckily possess a sort of happy consciousness which also recalls their puritanical great grandfathers who regarded profligacy as the greatest sin and much preferred saving to spending. In what follows I want to draw a portrait of this new postmodern posture. A few main assumptions underlie Kroker's and Cook's wake for postmodernism, which, in its peculiar genre of philosophic obituary, epitomizes and thus prepares for future oblivion views which were exceedingly popular in the preceding decade. First of all, the authors adopt Baudrillard's equation of Marx and Nietzsche: "Marx and Nietzsche shared a deep and common affinity in meditating upon historical (Christian) and materialistic (capitalist) expressions ofthewill ofpower."3 From Baudrillard's perspective Marx appears as a pathetic romantic who tried to defend the "referential illusion" by renaturalizing concrete labor even though its entirely abstract character was brilliandy revealed in Das Kapital. Bernard could simultaneously discuss Descartes's Third Meditation and cook you the perfect souffle while tossing scraps to his miniature poodle. He was a man of deep understanding, empathy, and humor. A dearth of literature focuses on the relationship between acculturation, power distance and liminality for migrant nurses entering foreign workplaces. Expectations are for migrant nurses to be practice‐ready swiftly. However, this aspiration is naïve given the complex shifts that occur in deeply held cultural beliefs and practices and is dependent on an organisational climate of reciprocal willingness to adapt and learn. This exploratory study identified that although a plethora of literature addresses challenges migrant nurses face, there are limited data that (...) link these transitional processes to concepts that might usefully guide transitions. This study draws from the overarching concept of acculturation, together with Hofstede's (2011) notion of power distance and the theory of liminality to explore the experiences of eight migrant nurses. Data highlighted that adjusting to altered hierarchical relationships took many months because negotiating power distance challenged deeply held beliefs and assumptions about professional and organisational hierarchies. Migrant nurses’ accounts indicated a paucity of organisational processes to address these difficulties; therefore, they navigated this liminal space of adjustment to power distance differences in an ad hoc manner. Their acculturation experiences, arguably unnecessarily prolonged, indicate the value in workplace commitment to exploring a collaborative, critically reflective approach to optimise transitions. The legal requirements and justifications for collecting patient-identifiable data without patient consent were examined. The impetus for this arose from legal and ethical issues raised during the development of a population-based disease register. Numerous commentaries and case studies have been discussing the impact of the Data Protection Act 1998 and Caldicott principles of good practice on the uses of personal data. But uncertainty still remains about the legal requirements for processing patient-identifiable data without patient consent for research purposes. This is (...) largely owing to ignorance, or misunderstandings of the implications of the common law duty of confidentiality and section 60 of the Health and Social Care Act 2001. The common law duty of confidentiality states that patient-identifiable data should not be provided to third parties, regardless of compliance with the DPA1998. It is an obligation derived from case law, and is open to interpretation. Compliance with section 60 ensures that collection of patient-identifiable data without patient consent is lawful despite the duty of confidentiality. Fears regarding the duty of confidentiality have resulted in a common misconception that section 60 must be complied with. Although this is not the case, section 60 support does provide the most secure basis in law for collecting such data. Using our own experience in developing a disease register as a backdrop, this article will clarify the procedures, risks and potential costs of applying for section 60 support. (shrink)

Belief polarization is said to occur when two people respond to the same evidence by updating their beliefs in opposite directions. This response is considered to be “irrational” because it involves contrary updating, a form of belief updating that appears to violate normatively optimal responding, as for example dictated by Bayes' theorem. In light of much evidence that people are capable of normatively optimal behavior, belief polarization presents a puzzling exception. We show that Bayesian networks, or Bayes nets, can simulate (...) rational belief updating. When fit to experimental data, Bayes nets can help identify the factors that contribute to polarization. We present a study into belief updating concerning the reality of climate change in response to information about the scientific consensus on anthropogenic global warming. The study used representative samples of Australian and U.S. participants. Among Australians, consensus information partially neutralized the influence of worldview, with free-market supporters showing a greater increase in acceptance of human-caused global warming relative to free-market opponents. In contrast, while consensus information overall had a positive effect on perceived consensus among U.S. participants, there was a reduction in perceived consensus and acceptance of human-caused global warming for strong supporters of unregulated free markets. Fitting a Bayes net model to the data indicated that under a Bayesian framework, free-market support is a significant driver of beliefs about climate change and trust in climate scientists. Further, active distrust of climate scientists among a small number of U.S. conservatives drives contrary updating in response to consensus information among this particular group. (shrink)

A number of authors have argued that Peano Arithmetic supplemented with a logical validity predicate is inconsistent in much the same manner as is PA supplemented with an unrestricted truth predicate. In this paper I show that, on the contrary, there is no genuine paradox of logical validity—a completely general logical validity predicate can be coherently added to PA, and the resulting system is consistent. In addition, this observation lead to a number of novel, and important, insights into the nature (...) of logical validity itself. (shrink)

A notion of feasible function of finite type based on the typed lambda calculus is introduced which generalizes the familiar type 1 polynomial-time functions. An intuitionistic theory IPVω is presented for reasoning about these functions. Interpretations for IPVω are developed both in the style of Kreisel's modified realizability and Gödel's Dialectica interpretation. Applications include alternative proofs for Buss's results concerning the classical first-order system S12 and its intuitionistic counterpart IS12 as well as proofs of some of Buss's conjectures concerning IS12, (...) and a proof that IS12 cannot prove that extended Frege systems are not polynomially bounded. BackgroundDecision-making in initiating life-sustaining health technology is complex and often conducted at time-critical junctures in clinical care. Many of these decisions have profound, often irreversible, consequences for the child and family, as well as potential benefits for functioning, health and quality of life. Yet little is known about what influences these decisions. A systematic review of reasoning identified the range of reasons clinicians give in the literature when initiating technology dependence in a child, and as a result helps determine the (...) range of influences on these decisions.MethodsMedline, EMBASE, CINAHL, PsychINFO, Web of Science, ASSIA and Global Health Library databases were searched to identify all reasons given for the initiation of technology dependence in a child. Each reason was coded as a broad and narrow reason type, and whether it supported or rejected technology dependence.Results53 relevant papers were retained from 1604 publications, containing 116 broad reason types and 383 narrow reason types. These were grouped into broad thematic categories: clinical factors, quality of life factors, moral imperatives and duty and personal values; and whether they supported, rejected or described the initiation of technology dependence. The majority were conceptual or discussion papers, less than a third were empirical studies. Most discussed neonates and focused on end-of-life care.ConclusionsThere is a lack of empirical studies on this topic, scant knowledge about the experience of older children and their families in particular; and little written on choices made outside ‘end-of-life’ care. This review provides a sound basis for empirical research into the important influences on a child’s potential technology dependence. (shrink)

The time and opportunity have finally arrived for the next phase of Septuagint research. Even though not all the books of the LXX have been completed by the Septuaginta-Unternehmen in Göttingen, by far the largest number of books have been assigned and are being prepared. Thus, text-critical work has largely been completed, or is in the process of being prepared. The next phase, hermeneutical research, is at hand. This phase naturally requires correct methodology. This applies to an acceptable textual theory (...) as well as to the reconstruction of the textual history of the LXX. This article takes the Septuagint of Proverbs as its point of comparison and discusses the following issues: novel research (monographs) and new research projects in conjunction with existing projects (exegetical commentaries, a theology of the Septuagint). The concept of reproductive health promises to play a crucial role in improving health care provision and legal protection for women around the world. This is an authoritative and much-needed introduction to and defence of the concept of reproductive health, which though internationally endorsed, is still contested. On the Dummettian understanding, anti-realism regarding a particular discourse amounts to (or at the very least, involves) a refusal to accept the determinacy of the subject matter of that discourse and a corresponding refusal to assert at least some instances of excluded middle (which can be understood as expressing this determinacy of subject matter). In short: one is an anti-realist about a discourse if and only if one accepts intuitionistic logic as correct for that discourse. On careful examination, the strongest (...) Dummettian arguments for anti-realism of this sort fail to secure intuitionistic logic as the single, correct logic for anti-realist discourses. Instead, antirealists are placed in a situation where they fail to be justified in asserting monism (that intuitionistic logic is the unique correct logic). Thus, antirealists seem forced either to accept pluralism (i.e. one or more intermediate logic is at least as `correct’ as intuitionistic logic–an option I take to be unattractive from the anti-realist perspective), or they must be anti-realists about the realism/anti-realism debate (and, in particular, must refuse to assert the instance of excluded middle equivalent to logical monism or logical pluralism). This paper applies concepts Deleuze developed in his ‘Postscript on the Societies of Control’, especially those relating to modulatory power, dividuation and control, to aspects of Australian schooling to explore how this transition is manifesting itself. Two modulatory machines of assessment, NAPLAN and My Schools, are examined as a means to better understand how the disciplinary institution is changing as a result of modulation. This transition from discipline to modulation is visible in the declining importance of the disciplinary teacher–student relationship (...) as a measure of the success of the educative process. The transition occurs through seduction because that which purports to measure classroom quality is in fact a serpent of modulation that produces simulacra of the disciplinary classroom. The effect is to sever what happens in the disciplinary space from its representations in a luminiferous ether that overlays the classroom. (shrink)

The No-No Paradox consists of a pair of statements, each of which ?says? the other is false. Roy Sorensen claims that the No-No Paradox provides an example of a true statement that has no truthmaker: Given the relevant instances of the T-schema, one of the two statements comprising the ?paradox? must be true (and the other false), but symmetry constraints prevent us from determining which, and thus prevent there being a truthmaker grounding the relevant assignment of truth values. Sorensen's view (...) is mistaken: situated within an appropriate background theory of truth, the statements comprising the No-No Paradox are genuinely paradoxical in the same sense as is the Liar (and thus, on Sorensen's view, must fail to have truth values). This result has consequences beyond Sorensen's semantic framework. In particular, the No-No Paradox, properly understood, is not only a new paradox, but also provides us with a new type of paradox, one which depends upon a general background theory of the truth predicate in a way that the Liar Paradox and similar constructions do not. In this paper, we present a formal recipe that Frege followed in his magnum opus “Grundgesetze der Arithmetik” when formulating his definitions. This recipe is not explicitly mentioned as such by Frege, but we will offer strong reasons to believe that Frege applied it in developing the formal material of Grundgesetze. We then show that a version of Basic Law V plays a fundamental role in Frege’s recipe and, in what follows, we will explicate what exactly this role is and (...) explain how it differs from the role played by extensions in his earlier book “Die Grundlagen der Arithmetik”. Lastly, we will demonstrate that this hitherto neglected yet foundational aspect of Frege’s use of Basic Law V helps to resolve a number of important interpretative challenges in recent Frege scholarship, while also shedding light on some important differences between Frege’s logicism and recent neo-logicist approaches to the foundations of mathematics. San Junipero, a virtual beach resort where the dead and dying can upload their minds, is much closer to the underworld of the ancient Greeks than the Christian Heaven. But it is not merely the people who are shades of themselves, in San Junipero our values will also fade as they are constituted in part by our human limitations. In this (...) town the residents experience no danger and can take no risks, therefore can make no real sacrifices for one another. This paper presents an overview of the dimensions of unsafe motherhood, contrasting data from economically developed countries with some from developing countries. It addresses many common factors that shape unsafe motherhood, identifying medical, health system and societal causes, including women's powerlessness over their reproductive lives in particular as a feature of their dependent status in general. Drawing on perceptions of Jonathan Mann, it focuses on public health dimensions of maternity risks, and equates the role of bioethics in conscientious medical care (...) to that of human rights in public health care. The microethics of medical care translate into the macroethics of public health, but the transition compels some compromise of personal autonomy, a key feature of Western bioethics, in favour of societal analysis. Religiously‐based morality is seen to have shaped laws that contribute to unsafe motherhood. Now reformed in former colonizing countries of Europe, many such laws remain in effect in countries that emerged from colonial domination. UN conferences have defined the concept of ‘reproductive health’ as one that supports women's reproductive self‐determination, but restrictive abortion laws and practices epitomize the unjust constraints to which many women remain subject, resulting in their unsafe motherhood. Pregnant women can be legally compelled to give the resources of their bodies to the support of others, while fathers are not legally compellable to provide, for instance, bone‐marrow or blood donations for their children's survival. Women's unjust legal, political, economic and social powerlessness explains much unsafe motherhood and maternal mortality and morbidity. (shrink)

During the Winter of 2011 I visited SADAF and gave a series of talks based on the central chapters of my manuscript on the Yablo paradox. The following year, I visited again, and was pleased and honored to find out that Eduardo Barrio and six of his students had written ‘responses’ that addressed the claims and arguments found in the manuscript, as well as explored new directions in which to take the ideas and themes found there. These comments reflect my (...) thoughts on these responses (also collected in this issue), as well as my thoughts on further issues that arose during the symposium that was based on the papers and during the many hours I spent talking and working with Eduardo and his students.
